Indian Government Rejects Monsanto’s Climate Resilient Plant Patent


indiaJustice Prabha Sridevi is the Chair of the Intellectual Property Appellate Board of India. Along with Hon Shri DPS Parmar, a technical member, they dismissed Monsanto’s appeal against the rejection of their patent application to the Patent office for “Methods of Enhancing Stress Tolerance in plants and methods thereof.” It’s great to see India denying Monsanto a patent for this genetically-engineered method of increasing climate resilience in plants. There are other ways, farmers have already evolved a variety of climate resilient crops.
The Intellectual Property Appellate Board said that the technology is only a discovery of a new property of known substance, not an invention, just as it states in section 3(d) of the India Patent Act (1).This is the first time that this section has been used on plant patents. The Act also specifies that plants and animals are not patentable, in section 3(j)(1). This is very significant, as other countries might look to make similar amendments.
With these very broad patents , corporations like Monsanto can prevent access to climate resilient seeds after climate disasters, because a patent is an exclusive right to produce, distribute, and sell the patented product(2). – Dr Vandana Shiva
 India has a long history with Monsanto, approximately 270,000 farmers have committed suicide in the last decade alone. Most of these suicides come from the cotton belt, and Monsanto now controls 95% of cotton seed supply through its GMO Bt cotton. All of this has continued while scientists discovered that Monsanto’s Bt toxins are harmful to human health, especially to red blood cells. You can read more about that here. It’s all about patents, Monsanto has taken over 1000 patents on climate resilient crops already. Farmers have already evolved climate resistant crops overtime because climate resistant traits are becoming more important due to unpredictable weather conditions.
The patent office refused to grant the patent as it was found that the application lacked an inventive step in view of (i) Willimsky Gerald Journal of bacteriology .Vol174,No 20 ,1992,6326-6335,(ii)  WO 90/09447and US 5470971.(ii) Claims do not define any invention under section 2(1)(ja) of the Patents Act, 1970 as structure and function of cold shock protein was already known in cited prior art and it is obvious to person skilled in plant to make transgenic plant. (iii) It is mere application of already known cold shock protein in producing cold stress tolerant plant and tolerant to heat, salt and drought conditions, claims fall within the scope of Section 3(d) of The Patents Act, 1970. (iv) . The patent office found that it is not patentable under 3(j) as claims also include essential biological process of regeneration and selection, which includes growing of plant in specific stress condition(2). – Dr. Vandana Shiva
Every year the human race seems to be uniting together in awareness to spread the word about our food industry. Since the recent worldwide march against Monsanto, hundreds of millions, if not billions of people are waking up to the fact that genetically modified foods (GMOs) and pesticides are really harmful to human health. Furthermore, the patenting of seed, controlling and owning the entire global food supply and the attempt to make the whole human race dependant on “terminator technology” has not sat well with many. Individual states like Maine, Connecticut and more within the United States have been speaking out and making progress, while dozens of other countries have completely banned Monsanto’s GMOs. The world really is waking up and making progress, and now India is making more noise. It’s amazing to see how much we are becoming aware of on our planet, and how much we are coming together and uniting for what resonates with us most. The world is becoming more transparent, it’s easier for us to see through corporate agendas.
In defining seed as their creation and invention, corporations like Monsanto shaped the Global Intellectual Property and Patent Laws so that they could prevent farmers from seed saving and sharing and force them into dependence  on their  patented GMO seeds.This is how the Trade Related Intellectual Property Rights (TRIPs) Agreement of the World Trade Organization was born.A Monsanto representative is on record stating that in drafting the TRIPS agreement, they were the patient, diagnostician, and physician all in one(2). – Dr. Vandana Shiva

This is a true story that had happened in 1892 at Stanford University. It's moral is still relevant today.
A young, 18 year old student was struggling to pay his fees. He was an orphan, and not knowing where to turn for money, he came up with a bright idea. A friend and he decided to host a musical concert on 
campus to raise money for their education.They reached out to the great pianist Ignacy J. Paderewski. His manager demanded a guaranteed fee of $2,000 for the piano recital. A deal was struck. And the boys began to work to make the concert a success.
The big day arrived. Paderewski performed at Stanford. But unfortunately, they had not managed to sell enough tickets. The total collection was only $1,600. Disappointed, they went to Paderewski and explained their plight. They gave him the entire $1,600, plus a cheque for the balance of $400. They promised to honour the cheque soonest possible. "No" said Paderewski. "This is not acceptable" He tore up the 
cheque, returned the $1,600 and told the boys "Here's the $1,600. Please deduct whatever expenses you have incurred. Keep the money you need for your fees. And just give me whatever is left" The boys 
were surprised, and thanked him profusely.
It was a small act of kindness. But it clearly marked out Paderewski as a great human being. Why should he help two people he did not even know? We all come across situations like these in our lives. And most of us only think "If I help them, what would happen to me?"
The truly great people think, "If I don't help them, what will happen to them?" They don't do it expecting something in return. They do it because they feel it's the right thing to do.
Paderewski later went on to become the Prime Minister of Poland. He was a great leader, but unfortunately when the World War began, Poland was ravaged. There were over 1.5 million people starving in his country, and no money to feed them.
Paderewski did not know where to turn for help. He reached out to the US Food and Relief Administration for help.
The head was a man called Herbert Hoover - who later went on to become the US President. Hoover agreed to help and quickly shipped tons of food grains to fee the starving Polish people. A calamity 
 was averted.Paderewski was relieved. He decided to go across to meet Hoover and personally thank him. When Paderewski began to thank Hoover for his noble gesture, Hoover quickly interjected and said, "You shouldn't be thanking me, Mr. Prime Minister. You may not remember this, but several years ago, you helped two young students go through college in the US. I was one of them."
The world is a wonderful place. What goes around usually comes around.

Shigeaki Hinohara is one of the world's longest-serving physicians and educators. Hinohara's magic touch is legendary: Since 1941 he has been healing patients at St. Luke's International Hospital in Tokyo and teaching at St. Luke's College of Nursing.

He has published around 15 books since his 75th birthday, including one "Living Long, Living Good" that has sold more than 1.2 million copies. As the founder of the New Elderly Movement, Hinohara encourages others to live a long and happy life, a quest in which no role model is better than the doctor himself.

Energy comes from feeling good, not from eating well or sleeping a lot. We all remember how as children, when we were having fun, we often forgot to eat or sleep. I believe that we can keep that attitude as adults, too. It's best not to tire the body with too many rules such as lunchtime and bedtime.

 
All people who live long regardless of nationality, race or gender share one thing in common: None are overweightFor breakfast I drink coffee, a glass of milk and some orange juice with a tablespoon of olive oil in it. Olive oil is great for the arteries and keeps my skin healthy. Lunch is milk and a few cookies, or nothing when I am too busy to eat. I never get hungry because I focus on my work. Dinner is veggies, a bit of fish and rice, and, twice a week, 100 grams of lean meat.

 
Always plan ahead. My schedule book is already full until 2014, with lectures and my usual hospital work. In 2016 I'll have some fun, though: I plan to attend the Tokyo Olympics!

 
There is no need to ever retire, but if one must, it should be a lot later than 65. The current retirement age was set at 65 half a century ago, when the average life-expectancy in Japan was 68 years and only 125 Japanese were over 100 years old. Today, Japanese women live to be around 86 and men 80, and we have 36,000 centenarians in our country. In 20 years we will have about 50,000 people over the age of 100...

Hospitals must be designed and prepared for major disasters, and they must accept every patient who appears at their doors. We designed St. Luke's so we can operate anywhere: in the basement, in the corridors, in the chapel. Most people thought I was crazy to prepare for a catastrophe, but on March 20, 1995, I was unfortunately proven right when members of the Aum Shinrikyu religious cult launched a terrorist attack in the Tokyo subway. We accepted 740 victims and in two hours figured out that it was sarin gas that had hit them. Sadly we lost one person, but we saved 739 lives.

 
Science alone can't cure or help people.Science lumps us all together, but illness is individual. Each person is unique, and diseases are connected to their hearts. To know the illness and help people, we need liberal and visual arts, not just medical ones.

 
Life is filled with incidents. On March 31, 1970, when I was 59 years old, I boarded the Yodogo, a flight from Tokyo to Fukuoka. It was a beautiful sunny morning, and as Mount Fuji came into sight, the plane was hijacked by the Japanese Communist League-Red Army Faction. I spent the next four days handcuffed to my seat in 40-degree heat. As a doctor, I looked at it all as an experiment and was amazed at how the body slowed down in a crisis.

 
Find a role model and aim to achieve even more than they could ever do. My father went to the United States in 1900 to study at Duke University in North Carolina. He was a pioneer and one of my heroes. Later I found a few more life guides, and when I am stuck, I ask myself how they would deal with the problem.

It's wonderful to live long. Until one is 60 years old, it is easy to work for one's family and to achieve one's goals. But in our later years, we should strive to contribute to society. Since the age of 65, I have worked as a volunteer. I still put in 18 hours seven days a week and love every minute of it.

Power of Gaytri Mantra

Gayatri mantra has been bestowed the greatest importance in Vedic dharma.
 This mantra has also been termed as Savitri and Ved-Mata, the mother of the Vedas.
Om bhur bhuvah swah
Tat savitur varenyam
Bhargo devasya dheemahi
Dhiyo yo nah pracho dayat

The literal meaning of the mantra is:O God! You are Omnipresent, Omnipotent and Almighty, You are all Light.
You are all Knowledge and Bliss. You are Destroyer of fear, You are Creator
of this Universe, You are the Greatest of all. We bow and meditate upon
Your light. You guide our intellect in the right direction.


The mantra, however, has a great scientific importance too, which somehow got lost in the literary tradition. The modern astrophysics and astronomy tell us that our Galaxy called Milky Way or Akash-Ganga contains approximately 100,000 million of stars. Each star is like our sun having its own planet system. We know that the moon moves round the earth and the earth moves round the sun along with the moon. All planets round the sun. Each of the above bodies revolves round at its own axis as well. Our sun along with its family takes one round of the galactic center in 22.5 crore years. All galaxies including ours are moving away at a terrific velocity of 20,000 mile s per second.


And now the alternative scientific meaning of the mantra step by step:

OM BHUR BHUVAH SWAH:
Bhur the earth, bhuvah the planets (solar family), swah the Galaxy. We observe that when an ordinary fan with a speed of 900 RPM (rotations Per minute) moves, it makes noise. Then, one can imagine, what great noise would be created when the galaxies move with a speed of 20,000 miles per second. This is what this portion of the mantra explains that the sound produced due to the fast-moving earth, planets and galaxies is Om. The sound was heard during meditation by Rishi Vishvamitra, who mentioned it to other colleagues. All of them, then unanimously decided to call this sound Om the name of God, because this sound is available in all the three periods of time,hence it is set (permanent). Therefore, it was the first ever revolutionary idea to identify formless God with a specific title (form) called upadhi. Until that time, everybody recognized God as formless and nobody was prepared to accept this new idea. In the Gita also, it is said, "Omiti ekaksharam brahma", meaning that the name of the Supreme is Om , which contains only one syllable (8/12). This sound Om heard during samadhi was called by all the seers nada-brahma a very great noise),but not a noise that is normally heard beyond a specific amplitude and limits of decibels suitedto human hearing. Hence the rishis called this sound Udgith musical sound of the above, i.e., heaven. They also noticed that the infinite mass of galaxies moving with a velocity of 20,000 miles/second was generating a kinetic energy = 1/2 MV2 and this was balancing the total energy consumption of the cosmos. Hence they named it Pranavah, which means the body (vapu) or store house of energy.

TAT SAVITUR VARENYAM:
Tat that (God), savitur the sun (star), varenyam worthy of bowing or respect. Once the form of a person along with the name is known to us, we may locate the specific person.Hence the two titles (upadhi) provide the solid ground to identify the formless God, Vishvamitra suggested. He told us that we could know (realize) the unknowable formless God through the known factors, viz., sound Om and light of suns (stars). A mathematician can solve an equation x2+y2=4; if x=2; then y can be known and so on. An engineer can measure the width of a river even by standing at the riverbank just by drawing a triangle. So was the scientific method suggested by Vishvamitra in the mantra in the next portion as under:-

BHARGO DEVASYA DHEEMAHI:
Bhargo the light, devasya of the deity, dheemahi we should meditate. The rishi instructs us to meditate upon the available form (light of suns) to discover the formless Creator (God). Also he wants us to do japa of the word Om (this is understood in the Mantra). This is how the sage wants us to proceed, but there is a great problem to realize it, as the human mind is so shaky and restless that without the grace of the Supreme (Brahma) it cannot be controlled. Hence Vishvamitra suggests the way to pray Him as under:

DHIYO YO NAH PRACHO DAYAT:
Dhiyo (intellect), yo (who), nah (we all), pracho dayat (guide to right Direction). O God!
Deploy our intellect on the right path. Full scientific interpretation of the Mantra: The earth (bhur), the planets (bhuvah), and the galaxies (swah) are moving at a very great velocity, the sound produced is Om , (the name of formless God.) That God (tat), who manifests Himself in the form of light of suns (savitur) is worthy of bowing/respect (varenyam).We all, therefore, should meditate (dheemahi) upon the light (bhargo) of that deity (devasya) and also do chanting of Om. May He (yo) guide in right direction (pra****ayat) our(nah) intellect dhiyo.


So we notice that the important points hinted in the mantra are:-

1) The total kinetic energy generated by the movement of galaxies acts as an umbrella and balances the total energy consumption of the cosmos. Hence it was named as the Pranavah (body of energy). This is equal to 1/2 mv2 (Mass of galaxies x squre of velocity.)

2) Realizing the great importance of the syllable OM , the other later date religions adopted this word with a slight change in accent, viz., Amen and Ameen.
